Pursuant to Governor Edward’s Proclamation No. 170 JBE 2021, entitled Amendment to State of Emergency – Hurricane Ida, all legal deadlines applicable to legal proceedings are suspended until September 24, 2021, including any deadlines set forth in the Louisiana Civil Code, Louisiana Code of Civil Procedure, Titles 9, 13, 18, 23, 32,40, 46, 47, 49, and 56 of the Louisiana Revised Statutes, and in legal proceedings in all courts, administrative agencies and boards (“Governor’s Proclamation”).  

The Governor’s Order specifically excludes the suspension of any prescriptive, peremptive or abandonment time periods over which the Louisiana Supreme Court has suspension authority pursuant to C.C.P. arts. 562 and 3472.1.  Pursuant to those articles, Chief Justice John Weimer of the Louisiana Supreme Court previously issued an Order dated August 31, 2021, suspending the period of prescription, peremption and abandonment by thirty days commencing from August 26, 2021, the Governor’s declaration of State of Emergency. The Governor’s Proclamation is an amendment to Proclamation No.: 165 JBE 2021, issued on August 26, 2021, wherein a State of Emergency was declared in Louisiana due to anticipated impacts from Hurricane Ida.  The current Governor’s Proclamation also addresses other Ida impacted issues including Unemployment Insurance and Ida Essential Lodging.   A copy of the Governor’s Proclamation can be found here.
