New Tech Changing Consent Laws?
April 8, 2026Louisiana has historically been a one party consent law state which allows one party to a conversation or interaction to record all participants. However, with emerging technology such as artificial intelligence, “wearable devices” such as Meta-Glasses , and other modern technology, discreet recording is becoming easier and more prevalent causing major safety concerns for some. Representative Laurie Schlegal of Metairie, Louisiana is sponsoring House Bill 410—a bill aimed at protecting against secret recordings. House Bill 410 provides the legislature’s finding that “undisclosed preservation and dissemination of direct conversations undermines trust, autonomy, dignity, privacy, and fairness.” The purpose of the bill is to protect people from non-consensual technological preservation and harmful dissemination of records. The proposed bill would require all parties to direct conversations be specifically informed of the recording. While this allows all parties to have the opportunity to terminate the conversation, the bill stops short of requiring consent before pressing record. The law defines a direct conversation as an in-person oral conversation under circumstances where one would not expect to be recorded. Importantly, this bill seemingly does not extend its protections to video-calls such as a Teams or Zoom meeting, although these platforms typically notify all participants of records through the site. This bill also does not extend to recordings of law enforcement for public/semi-public meetings. House Bill 410 has stalled, but is being amended in the House Civil Law and Procedure Committee before it will be brought before the full House.
