Property Damage - Water Contamination - Exception of Prescription Sustained - Dugas v. Bayou Teche Waterworks, Suit No. 110321

In 2010, Mr. Kerrigan and Mr. Keller represented a water works in Loreauville, Louisiana, in a lawsuit filed by a crawfish and rice farmer in Iberia Parish. The plaintiff allegedly sustained more than $14 million dollars in lost profits and revenue as a result of irrigating his ponds with water that was allegedly contaminated with "brine" from the water works. On June 22, 2010, the trial court granted the defendant's exception of prescription, issuing an Order with Reasons adopting most of the defendant's argument.
