Whitney Nat. Bank v. Cambridge Realty Corp. 690 So.2d 213

Whitney National Bank sued Cambridge Realty Corporation to collect on a money judgment and enforce its mortgage liens.  Cambridge Realty Corporation reconvened seeking the return of wrongfully seized rents and other relief.  The Trial Court granted each party's Motion for Summary Judgment in part and denied each Motion in part and subsequently amended those Judgments.  Whitney National Bank appealed.  The Fifth Circuit held that the Judgments appealed from were unauthorized partial summary judgments; that irreparable injury did not provide the basis for an Interlocutory Appeal; and even if the appeal was in a procedural posture of a Supervisory Writ Application, the Judgments were advisory opinions which should be vacated.
